WAIVER OF LIABILITY AND RELEASE RELATED 2SP SPORTS PROGRAMS
This form is an important legal document that explains the risks you are assuming by participating in 2SP Sports Strength & Conditioning program. It is critical that you have read and understand this document completely. If you do not understand any part of this document, it is your ultimate responsibility to ask for clarification prior to signing it.
I, has volunteered to participate in the Strength and Conditioning program for Strength & Conditioning provided to me by 2SP, which may include, but may not be limited to, weight training and conditioning exercises. In consideration of the 2SP training agreement to instruct and train me, I do here now and forever release and discharge and hereby hold harmless 2SP and his respective agents, heirs, assigns, contractors, and employees from any and all claims, demands, damages, rights of action or causes of action, present or future, arising out of or connected with my participation in this or any exercise program including any injuries resulting there from.
THIS WAIVER AND RELEASE OF LIABILITY INCLUDES, WITHOUT LIMITATION, INJURIES WHICH MAY OCCUR AS A RESULT OF (1) EQUIPMENT BELONGING TO 2SP SPORTS PERFORMANCE OR TO MYSELF THAT MAY MALFUNCTION OR BREAK; (2) ANY SLIP, FALL, DROPPING OF EQUIPMENT.
I, have been informed of, understand and am aware that any athlete training program, whether or not requiring the use of exercise equipment, is a potentially hazardous activity. I also have been informed of, understand and am aware that any exercise and/or fitness activities involve a risk of injury, as well as abnormal changes in blood pressure, fainting, and a remote risk of heart attack, stroke, other serious disability or death, and that I am voluntarily participating in these activities and using equipment and machinery with full knowledge, understanding and appreciation of the dangers involved. I hereby agree to expressly assume and accept any and all risks of injury, regardless of severity, or death.
I have been advised that an examination by a physician should be obtained by anyone prior to commencing a athlete training program, or initiating a substantial change in the amount of regular physical activity performed. If I have chosen not to obtain a physician’s consent prior to beginning this training program with 2SP Sports, I hereby agree that I am doing so solely at my own risk. In any event, I acknowledge and agree that I assume the risks associated with any and all fitness related activities and/or exercises in which I participate.
I , , Parent/Legal Guardian of , ACKNOWLEDGE THAT I HAVE THOROUGHLY READ THIS FORM IN ITS ENTIRETY AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. BY SIGNING THIS DOCUMENT, I AM WAIVING ANY RIGHT OR MY SUCCESSORS MIGHT HAVE TO BRING A LEGAL ACTION OR ASSERT A CLAIM AGAINST TRAINER FOR YOUR NEGLIGENCE OR THAT OF YOUR EMPLOYEES, AGENTS, OR CONTRACTORS.

WAIVER OF LIABILITY AND RELEASE RELATED TO CORONAVIRUS/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or perhaps by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death.
Strictly 2SP, LLC and its affiliates and subsidiaries, including without limitation 2SP Sports of Shelby, LLC and 2SP Sports of Bloomfield, LLC (collectively, “2SP”), cannot prevent you or your children from becoming exposed to, contracting, or spreading COVID-19 while utilizing 2SP’s services, equipment or premises. It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize 2SP’s services or equipment and/or enter onto 2SP’s premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.
ASSUMPTION OF RISK: I have read and understand the above warning concerning COVID-19. I hereby choose to voluntarily accept the risk of contracting COVID-19 for myself and/or my minor children in order to utilize 2SP’s services or equipment and/or enter onto 2SP’s premises. These services or equipment are of such value to me and/or my minor children, that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize 2SP’s services, equipment and/or premises in person.
WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring any action or suit against 2SP and its owners, officers, directors, managers, officials, trustees, agents, employees or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing 2SP’s services, equipment and/or premises. I understand that this waiver means I give up my right to bring any and all claims including for personal injury, death, disease or property loss, or any other loss, damage or liability whatsoever, including without limitation claims for negligence, and I give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.GOVERNING LAW AND VENUE. I understand and agree that this Waiver of Liability and Release will be governed by the laws of the State of Michigan without regard to any principles of conflicts of laws. I irrevocably consent to the sole and exclusive jurisdiction of and venue in the district court for the Eastern District of Michigan, or if federal subject matter jurisdiction does not exist, then in the courts of Oakland County, Michigan.I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS WAIVER OF LIABILITY AND RELEASE AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE.
